The Advance degree + 3 years of experience on H1B are not just a matter of fact formulation from the senators. It�s an effort to revert back to the 60�s through 80�s formula where the only way to immigrate to the US (at least for Engineers) was to pursue a master�s degree in the US and then adjust their status to a PR. There is a growing demand from academic institutions to revive this culture. America wants people to study here, specialize in evolving technologies and drive the technological innovation. Every day we see posts on this forum of folks wanting to include laws and regulations to fix the situation that they are in. We need to have a unified front with a common goal. May be we should learn from the �less educated� Latino community. They probably do not have the internet media to rally support but boy did they have their voice heard with ONE COMMON AGENDA.

I think its not going to be business as usual for H1b holders...nor the employers that sponsored them. I think something is going to change drastically in the coming months...it would be interesting to see what would happen to to the H1b for this FY when they open to doors to accept the application for new H1Bs..

I am not sure why it's so hard to understand what I want :)
1- My wife's h4 visa will expire after 4 years
2- I already have my h1b extension
3- What I am saying that if I don't get the stamp in time, I am planning to enter with AP

- visa in passport is originally stamped for Oct 2009 when I came from India, and I have my new I797 with validity date as Apr 2011. Do I still have I797 as valid even if I'm laid off?

Employer is required, by law, to notify USCIS when H1 employee is terminated (8 CFR Section 214.2 h.11). In that case, the H1 petition is canceled. Employer needs to make fresh H1 petition to rehire employee. However, in most cases, H1 will be cap exempt.

I did use my experience in my current company for my I 140 and my I 140 has been approved. I had 2 years of exp prior to joining my company and my LC was for 4 years exp, so I used 2 years of exp from my current company. From your priority date it looks like you have applied using RIR or traditional. I think it is true for PERM that you cannot use the experience of your current company but for RIR or Traditional you can.
So your lawyer is right in saying that you can use your exp with your current company.

My brother moved jobs early last year. He filed AC21 and got an RFE immediately.
The move was parallel in job function and the pay was good.
They replied to the RFE and then never heard back. In these economic times, USCIS
is scrutinizing every doc that gets filed.

Yes India, I totally second it. India as of now is a booming economy and will be in the future, we all are professionals educated if other economies can benefit why can�t our own benefit from what we have. People all talk about corruption, corrupted politicians, red tape etc, why don�t we take a step towards pushing it down, like once my friend said about putting a website that will expose all of them even a clerk who is corrupted can be captured on a mobile phone and posted on the site.. Just a thought and well being an immigrant means for some time in life you cant even vote(Voting is an important thing in democracy).I believe India will keep growing in the years to come and will be good option .I personally believe being a part of developing some thing even a country is great thing rather than sit on top of something that�s already developed by some one�Just a thought.;)

Some times they try to verify the information of the company such as the kind of business the company is into that the applicant is talking by doing a google search. It happened at one of my interviews..
They do all on the fly when the interview is happening. I could see the interviewer typing Google and then the name of the company..
I just saw this in latest Murthy bulletin about USCIS using Wikipedia and other internet based sources to gather information. This is serious news.

AILA members have been receiving denials based on the USCIS's use of information found on Wikipedia, an online encyclopedia to which anyone in the world may contribute information. SCOPS advised that it has notified the service centers and there should not be additional RFEs or denials based upon Wikipedia.
It should be noted that, as a corollary, applicants and petitioners should not try to use Wikipedia as support for their filings or arguments, since it has been deemed an unreliable source.

Great! I have been speaking to my colleagues and friends about IV. Trying to spread awareness about IV. Most have registered :) but not all have contributed.
One thing for sure, emails alone do not work. Each individual has to be called and followed. There are many who do not understand the gravity of the situation.
If all current members can get five more guys to register. Goals can be met in no-time.

Thanks. Where did you get the info on what docs to carry? Was it at the Texas DPS website?
I applied for DL for me and for my wife too..
the documents are same what were mentioned above...
If you are applying for a transfer from other state ...
Make sure that
1)you have your vehicle registered in TX ,
2) carry 2 proof of address .
3) carry proof of insurance ( they ask for this :confused:)
4) and carry your employment letter ....some times they insist on this .

Thanks lazycis for ur time to reply. is it must to fill I-9 form again to use with EAD even for the same employer. My attorney says continue as it is. mm.. confusing..
Btw, one more quesitons, for my son, I-485 status says Application rejected bcoz of incorrect fee (but attorney already sent correct fee !!) and I got I-131 AP for my son. Does that mean, USCIS accepted my sons I-485 application?.

glus, Since she now has an approved I140, she is eligible for a 3 year H1 extension, provided her PD is not current. She need not be continuously be on H1 to be eligible for applying H1 for the 7th year.
Once you get the H1 paper, you would have to enter the US, so that the status changes from "Adjustee" to "admitted" i.e., H1 status...or, if the H-1B paper come with the I-94 stub, you need not travel out and get it.
